Rules and regulations of the company Art Box Gallery S.A.

§1
Introductory provisions

  1. These Rules and Regulations set out the rules applicable within the multimedia space Art Box Experience, located in the Fabryka Norblina building at 51/53 Żelazna Street in Warsaw, operated by Art Box Gallery Spółka Akcyjna with its registered office in Warsaw, as well as the rules for the sale of Tickets for Exhibitions or Eventsheld at Art Box Experience.
  2. Every person present on the premises of Art Box Experience, in particular every person participating in Exhibitions or Events organised at Art Box Experience, is obliged to comply with the provisions of this document.

§2
Definitions

  1. The definitions and terms used in these Rules and Regulations shall be understood as follows:
    • “Art Box Metaverse” means a VR space operated by Art Box Gallery Spółka Akcyjna, where experiences of various themes take place, together with accompanying educational or cultural programmes conducted within Art Box Metaverse.
    • “Ticket” means a document confirming the conclusion of an agreement with the Company and entitling its holder to participate in a specific Exhibition or Event. The Ticket contains information specifying the title, date and time of the Exhibition, Event or thematic workshop.
    • A Ticket entitles the holder to a single admission to an Exhibition or Event on the date and at the time expressly indicated on it. A Ticket includes, among others, a Standard Ticket, Concession Ticket, Senior Ticket, VIP Ticket, Ticket for a Person with Disabilities, Family Ticket, but not exclusively.
    • “Standard Ticket” means a document confirming the conclusion of an agreement with the Company and entitling its holder to participate in a specific Exhibition or Event. A Standard Ticket contains information specifying the title, date and time of the Exhibition, Event or thematic workshop.
    • A Standard Ticket entitles the holder to a single admission to an Exhibition or Event on the date and at the time expressly indicated on it. A Standard Ticket is purchased at the full price in accordance with the Price List.
    • “Concession Ticket” means a document confirming the conclusion of an agreement with the Company and entitling its holder to participate in a specific Exhibition or Event. A Concession Ticket contains information specifying the title, date and time of the Exhibition, Event or thematic workshop.
    • A Concession Ticket entitles the holder to a single admission to an Exhibition or Event on the date and at the time expressly indicated on it. A Concession Ticket is available to children and school students who present a valid school ID at the time of entry to Art Box Experience and throughout the entire Exhibition or Event. A Concession Ticket is also available to students up to the age of 26 who present a valid student ID at the time of entry to Art Box Experience and throughout the entire Exhibition or Event.
    • “Senior Ticket” means a document confirming the conclusion of an agreement with the Company and entitling its holder—a senior aged over 65—to participate in a specific Exhibition or Event. The Ticket contains information specifying the title, date and time of the Exhibition, Event or thematic workshop.
    • The Ticket entitles the holder to a single admission to an Exhibition or Event on the date and at the time expressly indicated on it.
    • “Family Ticket” means a document confirming the conclusion of an agreement with the Company and entitling its holders—two adults and two children (over 5 years of age)—to participate in a specific Exhibition or Event. The Ticket contains information specifying the title, date and time of the Exhibition, Event or thematic workshop.
    • The Ticket entitles the holders to a single admission to an Exhibition or Event on the date and at the time expressly indicated on it. The Family Ticket is valid on Saturdays and Sundays.
    • “Ticket for a Person with Disabilities” means a document confirming the conclusion of an agreement with the Company and entitling its holder—a person who presents an appropriate document confirming disability—to participate in a specific Exhibition or Event. The Ticket contains information specifying the title, date and time of the Exhibition, Event or thematic workshop.
    • The Ticket entitles the holder to a single admission to an Exhibition or Event on the date and at the time expressly indicated on it.
    • “VIP Ticket” means a document confirming the conclusion of an agreement with the Company and entitling its holder to participate in a specific Exhibition and a specific Art Box Metaverse experience. The VIP Ticket contains information specifying the title, date and time of the Art Box Metaverse experience.
    • A VIP Ticket entitles the holder to a single admission to the Exhibition at Art Box Experience and to the Art Box Metaverse experience on the date and at the time expressly indicated on it. A VIP Ticket is purchased at the full price in accordance with the Price List.
    • “Price List” means the information provided by Art Box Experience on the Gallery premises or on the website: www.artboxexperience.com regarding the prices of individual Tickets, as well as entitlements to discounts.
    • “Gallery” means the multimedia exhibition space Art Box Experience located in the Fabryka Norblina building at 51/53 Żelazna Street in Warsaw, operated by the Company.
    • “Organised Group” means an organised group of Customers consisting of at least 10 (ten) persons.
    • “School Organised Group” means an Organised Group consisting of at least 10 pupils of kindergartens, primary schools and secondary schools, together with their chaperones.
    • “Box Office” means the stationary ticket sales point located on the Gallery premises.
    • “Customer” means any person purchasing a Ticket for an Exhibition or Event.
    • “Consumer” means a natural person performing a legal act not directly related to their business or professional activity, or a natural person to whom mandatory provisions of law grant consumer rights, solely within the scope of the granted rights.
    • “Rules and Regulations” means these Rules and Regulations of Art Box Experience.
    • “Programme” means the list of Exhibitions or Events held at Art Box Experience, indicating the title, date and planned start time of each Exhibition or Event.
    • “GDPR” means Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).
    • “Service” means an online ticketing service enabling the purchase of Tickets for a specific Exhibition or Event via the Internet, available on the website of the ticket sales operator selected by Art Box Experience.
    • “Company” means Art Box Gallery Spółka Akcyjna with its registered office in Warsaw, address: ul. Żelazna 51/53, 00-841 Warsaw, entered in the register of entrepreneurs kept by the District Court for the Capital City of Warsaw in Warsaw, 13th Commercial Division of the National Court Register under KRS number: 0000858691, NIP: 5213903496, REGON: 386704839.
    • The Company may also be referred to as: “Art Box Experience”.
    • “Event” means an event organised by the Company or a third party other than an Exhibition, including shows, concerts, film screenings, meetings, lectures, workshops, broadcasts or rebroadcasts of sports events, educational and music events or other types of events held on the Gallery premises. An Event may be ticketed and/or closed.
    • “Exhibition” means a multimedia exhibition of various themes organised by the Company, together with accompanying educational or cultural programmes held at Art Box Experience (including exhibitions of sculptures and other displays).
    • “Invitation” means a document issued by the Company entitling its holder to participate in a specific Exhibition or Event by exchanging it for a Ticket at the Gallery Box Office. An Invitation may also be referred to as a “Voucher”.
  2. Unless otherwise provided in these Rules and Regulations, any term used in a statement or notice submitted pursuant to or in connection with these Rules and Regulations shall have the meaning assigned to it herein.
  3. Headings used in these Rules and Regulations are for convenience only and do not affect interpretation.
  4. Any expressions used in the singular include the plural and vice versa.

§3
Rules for using Art Eox Experience

  1. Entry to Art Box Experience and participation in an Exhibition or Event is possible only upon presentation of a valid Ticket (including one indicating the correct date, time and name), Voucher or Invitation entitling the holder to participate in a specific Exhibition or Event.
  2. The Art Box Experience Programme is available on the Art Box Experience premises and on the website www.artboxexperience.com.
  3. The Company reserves the right to change the Programme, as well as to cancel individual Exhibitions or Events without stating a reason.
  4. Photographing the interior of the Gallery is permitted solely for the Customer’s personal use.
  5. The following are prohibited on the Gallery premises:
    • photographing the interior of the Gallery for commercial purposes;
    • organising any performances, product sessions, press interviews, media sessions;
    • bringing any professional video or photographic equipment;
    • commercial recording by any means of projections of Exhibitions or Events displayed in the Gallery or other audiovisual works, as well as the course of Exhibitions or Events, whether by recording image or sound using any recording devices, in particular cameras, mobile phones and microphones;
    • using flash, tripods or similar accessories;
    • bringing in and consuming food products or alcoholic beverages;
    • bringing dangerous items and substances, in particular weapons, sharp tools, explosives and pyrotechnics, flammable materials, corrosive substances and chemicals;
    • bringing oversized items, in particular luggage, bicycles, scooters or skateboards;
    • bringing in and using narcotic or psychotropic substances;
    • lighting fires, smoking tobacco products or using electronic cigarettes or similar devices;
    • behaviour disrupting the course of an Exhibition or Event, in particular loud conversations, talking on the phone, playing music;
    • damaging property, including objects and equipment of the Gallery, in particular by entering the Gallery wearing footwear that may damage the floor (e.g. high heels);
    • conducting commercial, marketing or canvassing activities;
    • touching exhibits, climbing onto exhibits, or photographing exhibits with flash;
    • touching sculptures, climbing onto sculptures, or photographing sculptures with flash;
    • performing any activities or actions that may cause damage to or destruction of the building, structures, objects, sculptures or other exhibits located in Art Box Experience;
    • removing elements of the Exhibition (sculptures, displays, etc.);
    • destroying any elements of the Exhibition.
  6. Any derogations from the prohibitions set out in section 5 of this paragraph require the consent of Art Box Experience. To obtain consent, the Company must be contacted by phone or in person, or an inquiry must be sent to: info@artboxexperience.com, including a description of the requested derogation. Sending an inquiry does not mean that Art Box Experience has granted consent.
  7. Conducting any classes/lessons/workshops on the premises of Art Box Experience by external entities requires the written consent of Art Box Experience.
  8. Art Box Experience does not have a supervised cloakroom and therefore is not responsible for items left there. Customers are obliged not to leave any items behind in the Gallery, including personal belongings. The Company is not responsible for items left on the premises of Art Box Experience.
  9. Exhibitions or Events may use light and sound effects that may affect the well-being of some visitors. They are therefore not recommended for persons suffering from epilepsy, anxiety disorders, heart disease, seizures or sensitivity to flashing lights, as well as for persons who may easily lose balance.
  10. The Participant enters the Exhibition area at their own risk and undertakes to exercise due care and to follow the instructions of the organiser and security staff.
  11. The Organiser is not liable for damage caused by the fault of the injured party or third parties, unless the damage resulted from the Organiser’s wilful misconduct or gross negligence. In the event of injury, the Participant shall immediately report the incident to the organiser’s employee and complete a written incident report. These provisions do not infringe consumer rights arising from mandatory provisions of law.
  12. In the event of a delay in the start of an Exhibition or cancellation of an Exhibition for technical reasons, the Customer may obtain a new Ticket for the next date of the Exhibition or a refund of the paid Ticket price.
  13. Minors under 13 (thirteen) years of age may remain on the premises of Art Box Experience only under the supervision of adults.
  14. Parents or guardians are responsible for damage caused by minors.
  15. After leaving an Exhibition or Event, re-entry on the basis of the same Ticket is not possible.
  16. If the Customer fails to comply with these Rules and Regulations, Art Box Experience staff have the right to call upon the Customer to cease the violation. If such call is ineffective, Art Box Experience staff are authorised to demand that the Customer leave the Art Box Experience premises, without the right to a refund of the Ticket fee paid.
  17. Gallery staff have the right to demand that a Customer immediately leave the Gallery premises if the Customer grossly violates these Rules and Regulations, in particular if their behaviour:
    • infringes the comfort of other visitors or Art Box Experience staff,
    • endangers the safety of other persons on the premises of Art Box Experience,
    • prevents or hinders other Customers from using Art Box Experience, in particular from experiencing an Exhibition or Event,
    • does not have a Ticket.
  18. Exhibitions and events organised at Art Box Experience are legally protected and selling admission tickets for them via third parties without Art Box Experience’s written consent is unauthorised.
  19. In cases provided for by law, in particular the Act of 26 October 1982 on upbringing in sobriety and counteracting alcoholism (Journal of Laws 1982, No. 35, item 230 as amended), the Company may organise Exhibitions or Events available exclusively to specific groups of Customers.

§4
Tickets

  1. The Company sells Tickets specified in the Price List.
  2. The Company sells Tickets via the Box Office or the Service.
  3. Tickets for Organised Groups or School Organised Groups may be purchased via e-mail: edukacja@artboxexperience.com, or by phone at: +48 728 946 168 or +48 668 864 701.
  4. A Ticket may be obtained by exchanging an Invitation for a Ticket at the Box Office.
  5. Minors up to 5 (five) years of age are entitled to free admission to an Exhibition or Event and are not obliged to purchase Tickets.
  6. The Customer pays for the purchased Ticket as follows:
    • at the Box Office: cash or payment card;
    • via the Service: in the manner specified by the Service;
    • for Organised Groups or School Organised Groups: cash, payment card or bank transfer.
  7. The condition for purchasing a Ticket via the Service is obtaining confirmation of payment of the purchase price. Immediately after receiving transaction confirmation, the Service will send the Customer, to the e-mail address provided in the Ticket order, relevant information together with the purchased Ticket bearing an individual code. The Company reserves that the process of obtaining the confirmation from the Service referred to in the first sentence may take up to 30 (thirty) minutes from the moment the Customer selects the Ticket delivery method and accepts the order.
  8. Immediately after receiving transaction confirmation, the Service will send the Customer, to the e-mail address provided in the order, relevant information together with the purchased ticket bearing an individual code.
  9. In the case of card payment at the Box Office, the condition for purchasing a Ticket is that the Company first obtains confirmation of payment of the purchase price.
  10. For Organised Groups or School Organised Groups, payment for the purchased Tickets must be made on the day of visiting the Exhibition or participating in the Event, or on a date agreed with Art Box Experience.
  11. At the Customer’s request submitted in accordance with applicable law, in particular the Act of 11 March 2004 on tax on goods and services (Journal of Laws 2004, No. 54, item 535 as amended), the Company will issue an appropriate accounting document for the purchase of the Ticket, in particular a VAT invoice or a pro forma invoice.
  12. For an additional fee, it is possible to visit the Exhibition with an educator. A booking for a visit with an educator must be made at least seven days in advance by arranging the visit date with Art Box Experience. Free cancellation of a visit with an educator may be made no later than 48 (forty-eight) hours before the start of the visit. The fee for the service is due in the event of cancellation later than 48 (forty-eight) hours before the start of the visit or in the event of failure to appear for the scheduled visit.
  13. One Ticket entitles only one Customer to participate in an Exhibition or Event, unless the nature of the purchased special or promotional Ticket provides otherwise. The Ticket entitles participation in a specific Exhibition or Event to be held on a specified day and time.
  14. The Company sets Ticket prices for individual Exhibitions or Events separately for each Exhibition or Event and makes them available to Customers in the Price List on www.artboxexperience.com, via the Service and at the Box Office.
  15. Art Box Experience staff have the right to request the Customer to present a document entitling the Customer to purchase a Concession Ticket, a Ticket for a Person with Disabilities or a Senior Ticket. If the Customer refuses to present such documents, the Customer is obliged to pay the difference between the price of a Standard Ticket and the price of the Concession Ticket, the Ticket for a Person with Disabilities or the Senior Ticket, or the Family Ticket.
  16. The Company is not liable for the Customer providing an incorrect e-mail address or incorrect telephone number in the Service, resulting in delayed entry to the Exhibition or Event and the need to manually locate the Ticket purchase transaction for that Customer.
  17. The Customer is obliged to present the Ticket at the request of Art Box Experience staff upon entry to an Exhibition or Event and to keep it for the entire duration of the Exhibition or Event, as well as to present the Ticket upon any request of Art Box Experience staff.
  18. A Ticket that is illegible or damaged in such a way that it is not possible to read the data contained therein may be deemed invalid by Art Box Experience staff and not entitling the holder to participate in an Exhibition or Event.
  19. Information regarding the Gallery opening hours is available on www.artboxexperience.com or at the Box Office.

§ 5
Arrangements concerning organised groups and school organised groups

  1. An Organised Group consisting of minors should remain on the Gallery premises under the supervision of at least one adult who is the chaperone of the Organised Group.
  2. In the case of a School Organised Group consisting of secondary school students, one adult chaperone should supervise a maximum of 15 (fifteen) students, and in the case of a School Organised Group consisting of primary school students—a maximum of 10 (ten) students.
  3. Chaperones of an Organised Group or School Organised Group are responsible for the conduct of their charges and for any damage caused by them.
  4. The person collecting Tickets on behalf of an Organised Group or School Organised Group is obliged to provide the transaction number and present proof of payment.
  5. Organised Groups visiting the Exhibition with an educator may consist of no more than:
    • 30 persons – School Organised Groups;
    • 40 persons – other Organised Groups.
  6. Entry of School Organised Groups is possible only under the supervision of a guide or educator licensed by Art Box Experience, or after obtaining prior written consent of Art Box Experience—without a guide or educator.
  7. In the case of a booked visit with an educator, if the Organised Group is more than 15 minutes late, the educator has the right to refuse to provide the service without refund of the guiding fee.
  8. Art Box Experience has the right to refuse entry to or to request the removal of an Organised Group whose behaviour may hinder other visitors’ visit to the Exhibition.

§ 6
Sale of food products and alcoholic beverages

  1. The Customer may purchase food products or alcoholic beverages on the Gallery premises.
  2. Alcoholic beverages are not sold to intoxicated persons or to minors under 18 (eighteen) years of age.
  3. Bringing food products or alcoholic beverages into the Exhibition area is prohibited.

§7
Workshops

  1. The Customer may participate in thematic workshops or another Event after prior purchase of a separate Ticket dedicated specifically to that Event or workshop.
  2. Bringing food products, beverages, alcoholic beverages, as well as intoxicating substances into the Event or workshop area is prohibited.
  3. Consuming food products, beverages, alcoholic beverages, as well as intoxicating substances in the Event or workshop area is prohibited.
  4. Minors participating in thematic workshops or an Event may remain on the premises of Art Box Experience only under the supervision of adults.
  5. Parents or guardians are responsible for the conduct and any damage caused by minors during participation in thematic workshops or an Event.
  6. Throughout the entire workshop or Event, it is prohibited to run, touch screens, move around and separate from the group with tools dedicated to the workshop or Event.
  7. Throughout the entire workshop or Event, responsibility for minors rests with their chaperones or parents.
  8. Art Box Experience is not liable for any damage suffered or caused by participants of an Event or workshop.
  9. Minors participating in thematic workshops or an Event use the tools and products prepared for the workshop or Event under the supervision and sole responsibility of their parents and guardians. 

§8
Ticket refunds

  1. Art Box Experience has the right to cancel an Exhibition or Event without stating a reason. Customers who purchased Tickets for a cancelled Exhibition or Event will be refunded the paid Ticket price at the Box Office or via the Service.
  2. The Company informs that pursuant to Article 38(1)(12) of the Act of 30 May 2014 on consumer rights (Journal of Laws 2014, item 827 as amended), the Consumer does not have the right to withdraw from a contract concluded off-premises or at a distance in relation to a contract for the provision of services related to entertainment, sports or cultural events, if the contract specifies the day or period of performance.
  3. In the case of refund of Tickets under § 8(1) of these Rules and Regulations purchased at the Box Office, in order to receive a refund the Customer should:
    • report to the Box Office,
    • provide the transaction identifier number of the purchased Ticket,
    • present proof of purchase of the Ticket.
  4. In the case of refund of Tickets purchased via the Service, the rules and method of refund are governed by the Service’s regulations available on the website of the Service through which the purchase was made.
  5. In the case of refund of Tickets under § 8(1) purchased by an Organised Group or School Organised Group, in order to receive a refund the Customer should:
    • report to the Box Office or submit a refund request by e-mail to: edukacja@artboxexperience.com or info@artboxexperience.com,
    • provide the transaction identifier number of the purchased Ticket.
  6. Invitations are not subject to refund or exchange.
  7. In the case of refund of Tickets purchased using a coupon or voucher other than an Invitation, the coupons or vouchers are not refundable and may not be used again.
  8. Exchange of a Ticket for another date of an Exhibition or Event is possible in the following situations:
    • the Exhibition or Event will not take place due to the fault of the Company,
    • for Customers other than Organised Groups or School Organised Groups—if the request to change the date is submitted at the Box Office at least 48 (forty-eight) hours before the date and time of the visit shown on the Ticket;
    • for Organised Groups or School Organised Groups—if the request to change the date is submitted by e-mail to: edukacja@artboxexperience.com (for School Organised Groups) or info@artboxexperience.com (for Organised Groups) at least 7 (seven) days before the visit date shown on the Ticket.

§ 9
Complaints and liability for conformity of performance with the contract

  1. Complaints regarding Exhibitions or Events, or Tickets offered by the Company should be submitted by e-mail to: info@artboxexperience.com.
  2. Complaints regarding Tickets and online payments made via the Service should be submitted in accordance with the Service’s regulations.
  3. Complaints regarding the purchase of Tickets and online payments made via the Service are handled by the Service operator, under the terms set out in the Service’s regulations, via which the purchase was made.
  4. A complaint should include:
    • the Customer’s details together with a correspondence address or e-mail address,
    • the date of participation in the Exhibition or Event or the date of Ticket purchase,
    • a description of the subject of the complaint.
  5. The Company will respond to the complaint in writing to the correspondence address indicated or via e-mail no later than within 14 (fourteen) days from the date of receipt; however, this period may be extended in exceptional situations.
  6. In the event of non-performance or improper performance by the Company of obligations under the contract or these Rules and Regulations, the Company is obliged to remedy the damage suffered by the Customer, unless the non-performance or improper performance results from circumstances for which the Company is not liable.

§ 10
Out-of-court methods of handling complaints and pursuing claims

  1. The Company hereby informs that a Customer who is a Consumer may use out-of-court methods of handling complaints and pursuing claims.
  2. Detailed information on the possibility for a Consumer to use out-of-court methods of handling complaints and pursuing claims and the rules of access to such procedures are available at the offices and websites of district (municipal) consumer ombudsmen, social organisations (whose statutory tasks include consumer protection), Provincial Inspectorates of the Trade Inspection, and on the following websites of the Office of Competition and Consumer Protection:
  3. The use of out-of-court methods of handling complaints and pursuing claims is voluntary for the Company or the Customer. This information does not constitute an obligation of the Company to use out-of-court dispute resolution methods.

§ 11
CCTV monitoring and security

  1. The Company informs that the Gallery premises are monitored by CCTV.
  2. CCTV monitoring is conducted to ensure the safety of Customers and Gallery staff, protect property, as well as to determine liability, pursue claims or defend against claims if necessary. By purchasing a Ticket, the Customer consents to the recording of their image by such CCTV cameras.
  3. Recordings are stored for a period of 20 (twenty) days from the date of recording.
  4. Processing of personal data in connection with recording an image via CCTV cameras is carried out under the principles set out in a separate document.

§ 12
Personal data protection

  1. The Company declares that legal provisions—both the GDPR and the Act of 10 May 2018 on personal data protection (Journal of Laws 2018, item 1000 as amended)—authorise the Company to process Customers’ personal data.
  2. The controller of personal data is Art Box Experience. Contact with the Company regarding personal data processing: phone +48 511 228 779 or e-mail marta@artboxexperience.com.
  3. The Company informs that:
    • it processes the following personal data of Customers: first name(s) and last name(s), contact details (telephone number, e-mail address),
    • the Company may request other personal data than those specified in item 1) above where necessary to exercise a right or fulfil an obligation resulting from law;
    • the provision of personal data to the Company takes place in the form of the Customer’s statement or by obtaining personal data during performance of the contract;
    • collecting, recording, organising, structuring, storing, adapting or altering, retrieving, consulting, using, disclosing by transmission, dissemination or otherwise making available, aligning or combining, restricting, erasing or destroying personal data constitutes processing;
    • personal data will be processed for the purpose of performing the contract, i.e. enabling the Customer to participate in an Exhibition or Event. Provision of personal data is:
      • necessary to place an order for Tickets—pursuant to Article 6(1)(b) GDPR;
      • necessary for purposes arising from the legitimate interests pursued by the Company (securing the pursuit of potential claims; internal needs of the Company—accounting, reporting)—pursuant to Article 6(1)(f) GDPR;
    • providing personal data within the scope indicated in item 1) above is necessary to place an order for Tickets. Providing other personal data (based on the Customer’s consent) is voluntary, and consent may be withdrawn at any time; however, withdrawal does not affect the lawfulness of processing prior to withdrawal;
    • personal data will be stored for the period necessary for the purposes arising from the legitimate interests pursued by the Company (securing the pursuit of potential claims)—pursuant to Article 6(1)(f) GDPR, as well as for the period resulting from legal provisions regarding orders and payments;
    • personal data are processed only by employees or permanent collaborators authorised in writing by the Company for the purpose of performing the contract. Persons authorised to process such data are obliged to keep them confidential;
    • personal data are or may be transferred to the following categories of entities:
      a) providers of services supplying the Company with technical and organisational solutions enabling conclusion of contracts with Customers and management of the Company’s organisation,
      b) providers of legal and advisory services and supporting the Company in pursuing claims (in particular law firms, debt collection companies),
      c) other entities entrusted by the Company with personal data processing while ensuring full guarantees of data security,
      provided that all indicated entities will have access only to the personal data necessary to perform their specific functions and solely for that purpose.
    • personal data may be made available to entities located outside the European Union or the European Economic Area. Such entities may be located in countries where applicable personal data protection law ensures a lower level of protection than in the Customer’s country of residence. In such case, the Company ensures an appropriate level of protection by obliging entities to comply with the principles of the EU–U.S. Data Privacy Framework or by obliging the given entity to sign the so-called model clauses (“EC Model Clauses”) approved by the European Commission;
    • personal data are not used for automated decision-making, including profiling.
    • where personal data are processed on the basis of the Company’s legitimate interest under Article 6(1)(f) GDPR, the Customer has the right to object to the processing.
    • the Customer has the following rights:
      • the right of access to their data and to receive a copy,
      • the right to rectification (correction) of personal data,
      • the right to restriction of processing,
      • the right to erasure of personal data,
      • the right to data portability,
      • the right to lodge a complaint with the President of the Personal Data Protection Office (UODO) (address: Urząd Ochrony Danych Osobowych, ul. Stawki 2, 00-193 Warsaw). 

§ 13
Final provisions

  1. These Rules and Regulations are effective as of 27 June 2023.
  2. The Rules and Regulations are available on the Gallery premises and on the website: www.artboxexperience.com.
  3. The Company reserves the right to introduce changes to the Rules and Regulations at any time.
  4. The Company reserves the right to regulate the rules for organising individual Exhibitions or Events in separate regulations. The above also applies to rules in force in the Gallery in connection with the introduction of an epidemic threat state or epidemic state, in particular in connection with the COVID-19 pandemic.
  5. In matters not regulated herein, generally applicable provisions of Polish law shall apply, in particular the Act of 23 April 1964 – the Civil Code (Journal of Laws 1964, No. 16, item 93 as amended) and the Act of 30 May 2014 on consumer rights (Journal of Laws 2014, item 827 as amended).
  6. Any disputes arising or that may arise in connection with these Rules and Regulations shall be resolved by the Polish common court having jurisdiction over the Company’s registered office.
